Terms of service
Last updated
These terms are an agreement between you and Cashbear App, in Phnom Penh, Cambodia ("CashBear", "we" and "us"). They cover your use of the CashBear point of sale app for iPhone and iPad, our website, and our support (together, the "service"). By creating an account or using the service, you agree to these terms. If you use CashBear on behalf of a business, you agree to them for that business, and "you" means that business.
Who can use CashBear
- CashBear is a business tool. You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract.
- You must use CashBear for a real business and follow the laws that apply to it, including laws on sales, tax, consumer protection and receipts.
Your account
- You sign in with your mobile phone number and a one-time code we send you through Telegram. Keep your phone and Telegram account secure. You are responsible for everything done through your account.
- The information you give us about your business must be accurate, and you must keep it up to date.
- Tell us right away at [email protected] if you believe someone has accessed your account without permission.
Staff and devices
- You can add staff, give them roles and branch access, and let them sign in on shared devices with a PIN. You are responsible for who you add, the permissions you give them, and what they do in CashBear.
- Remove staff access as soon as someone should no longer have it.
Plans and subscriptions
Free plan. The free plan includes limits, such as on daily sales, branches, staff and tables. We show the current limits in the app. When you reach a limit, some actions stop working until the next day or until you upgrade.
Premium. Premium removes or raises these limits and is available as a monthly or yearly subscription. Prices are shown in the app before you buy and may vary by country.
You can buy Premium in two ways: in the app through Apple, or directly from us. The terms below for each apply depending on how you paid.
Billing through Apple. Subscriptions bought in the app are sold and billed by Apple through your Apple ID. Apple's terms and payment policies also apply.
- Payment is charged to your Apple ID when you confirm the purchase.
- Your subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Your Apple ID is charged for the renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in Settings > [your name] > Subscriptions on your device. If you cancel, Premium stays active until the end of the period you have paid for, and then your account moves to the free plan.
- Refunds are handled by Apple under Apple's policies. We cannot issue refunds for purchases made through Apple.
- If a renewal payment fails, Apple may give you a short grace period. If payment is not recovered, your account moves to the free plan.
Paying us directly. You can also buy Premium directly from us or from an authorized CashBear reseller, and pay by any local banks in Cambodia.
- Premium is activated for your account once we confirm your payment, and runs for the period you paid for, such as one month or one year.
- Direct subscriptions do not renew automatically. Before your period ends, we will remind you so you can pay for the next one. If we do not receive payment by the end of the period, your account moves to the free plan.
- Prices are those in the quote or invoice we give you, and include or exclude taxes as stated on it. You are responsible for any bank or transfer fees on your side.
- Payments are non-refundable.
- We will give you a receipt or invoice for each payment. Please keep it, as we may ask for it if there is a question about your subscription.
- If you have both an Apple subscription and a direct subscription, they are separate. Cancelling one does not cancel or refund the other.
Moving to the free plan does not delete your data. If your account has more branches, staff or tables than the free plan allows, you may not be able to add more or use some of them until you upgrade again.
Price changes. We may change subscription prices. For Apple subscriptions, Apple will notify you in advance and, where required, ask for your consent before a higher price applies. For direct subscriptions, a new price applies only from your next period after you have been told about it. It never changes a period you have already paid for.
Your data
- You own the business data you put into CashBear, such as your products, inventory, sales and customer records. You give us permission to store, process and display it only to provide and improve the service, as described in our Privacy Policy.
- If you store information about your own customers, you are responsible for having a lawful basis to collect it and for informing your customers. We process it only on your behalf.
- You can export sales and inventory as CSV files at any time. We recommend keeping your own copies of records you are legally required to keep, such as tax records.
Acceptable use
You agree not to:
- Use CashBear for anything illegal, fraudulent or deceptive, including recording false sales or hiding income from tax authorities.
- Upload content that you do not have the right to use, or that is harmful, offensive or infringes someone else's rights.
- Try to access accounts, data or systems that are not yours, or bypass plan limits, staff permissions or other security measures.
- Copy, reverse engineer, resell or build a competing product from the service, except where the law allows it.
- Overload, disrupt or attack the service, or use automated tools to access it without our permission.
Our service
- We work to keep CashBear available and accurate, but the service may sometimes be unavailable, for example during maintenance, updates or outages. We may require you to update the app to keep using it.
- CashBear helps you calculate totals, taxes and discounts based on the settings you enter. You are responsible for checking that your prices, tax rates and receipts are correct and meet your local requirements. CashBear is not tax, accounting or legal advice.
- CashBear does not process card payments. Payment methods recorded in the app are for your records only. Payments between you and your customers are your responsibility.
- We may add, change or remove features. If we remove a major Premium feature, we will tell you in advance.
Our intellectual property
CashBear, its app, website, design, logos and content belong to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use the app for your business while your account is open and you follow these terms. The app is licensed through Apple, and Apple's standard license terms for apps also apply.
Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
Ending your account
- You can delete your account at any time in Settings > Merchant Profile > Delete Account. If you sign back in within 30 days, the deletion is cancelled. After 30 days, we permanently delete your account and data as described in our Privacy Policy. Deleting your account does not cancel an Apple subscription, so cancel it in your device settings too. Time remaining on a direct subscription is not refunded when you delete your account, except where the law requires it.
- We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if your use puts other users or the service at risk. Where reasonable, we will tell you first and give you a chance to export your data.
Disclaimers
To the extent the law allows, the service is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or fit for a particular purpose. Some places do not allow these exclusions, so some of them may not apply to you.
Limitation of liability
To the extent the law allows:
- We are not liable for indirect or consequential losses, such as lost profits, lost sales, lost data or business interruption.
- Our total liability to you for any claim relating to the service is limited to the amount you paid us for the service in the 12 months before the claim, or USD 100 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for rights you have as a consumer that cannot be waived.
Indemnity
You agree to cover our reasonable costs and losses from claims by third parties, including your customers and staff, that arise from your business, your data, or your breach of these terms or the law.
Governing law and disputes
These terms are governed by the laws of Cambodia. Before starting any formal dispute, please contact us at [email protected] so we can try to resolve it. Any dispute that cannot be resolved this way will be handled by the courts of Cambodia, unless the law where you live gives you the right to bring it elsewhere.
Changes to these terms
If we change these terms, we will update the date above. For significant changes, we will notify you in the app before they take effect. If you keep using CashBear after changes take effect, you accept the new terms. If you do not agree, you can stop using the service and delete your account.
General
- If any part of these terms cannot be enforced, the rest remains in effect.
- If we delay enforcing a right, we do not give it up.
- You may not transfer these terms to someone else without our permission. We may transfer them as part of a merger or sale of our business.
- These terms and our Privacy Policy are the entire agreement between you and us about the service.
